The Consumer Protection Act has been one of the most hotly debated bills in recent times and looks after the well being of the average consumer out in the market. Despite all the hype, the Consumer Protection Act or CPA has been dragging along and has not really received the uptake in the business world it deserves.
Some of the penalties that can be brought against you and your company of a very substantial nature and not many people know if they are breaking the law through their actions. Consumer Protection Act Risk Questions:
- Do you market through any direct, catalogue or mail marketing?
- Are there sometimes discrepancies in respect of prices displayed and prices which are charged to customers?
- Do you offer customers the option to repair, refund or replace a defective good if it is returned within six months of purchase?
- Do you operate a customer loyalty programme?
- Is your warranty period on all goods at least six months?
- Do you provide clients with vouchers, store credits and/or allow prepayments?
- Do you sell bundled or packaged goods without such items also being available individually?
- Do you have any consumer fixed-term contracts?
- Do any of your legal contracts contain complicated legal concepts or Latin wording?
- Do you clearly label all items which are reconditioned or grey market goods as such?
If you have answered yes to 3 or more of the questions above, you and your organization may be at risk.
